WorthItProperty operates as a real estate data intelligence and research platform, providing aggregated parcel-level insights, analytics, and property-related information derived from publicly available and licensed third-party sources. WorthItProperty does not host auctions, sell real estate, provide brokerage services, offer legal or financial advice, or act as a lender.

By accessing or using the Website, you agree to be bound by these Terms. If you do not agree, you must immediately discontinue use of the Website.

1. License Grant

The Website is licensed, not sold. Subject to your compliance with these Terms, WorthItProperty grants you a revocable, non-exclusive, non-transferable, limited license to access and use the Website solely for your internal research, evaluation, and lawful business purposes.

No ownership rights are transferred to you under these Terms.

By activating a Subscription, you authorize WorthItProperty and its payment processors (including Stripe) to charge your selected payment method on a recurring basis until canceled.

3.3 Auto-Renewal and Cancellation

Subscriptions automatically renew monthly or annually unless canceled before the renewal date. Cancellations made less than 24 hours before renewal may take effect in the next billing cycle.

3.4 Failed Payments

WorthItProperty may suspend or terminate access if payment fails or remains unpaid.

3.5 Refund Policy

All charges are final unless otherwise determined at WorthItProperty’s sole discretion.

4. Intellectual Property

All Website content, including but not limited to software, layouts, algorithms, scoring logic, data structures, visualizations, branding, and documentation, are the exclusive property of WorthItProperty or its licensors.

To the maximum extent permitted by law, WorthItProperty shall not be liable for indirect, incidental, consequential, special, or exemplary damages.

WorthItProperty’s total aggregate liability shall not exceed five hundred dollars ($500.00).

11. Indemnification

You agree to indemnify and hold harmless WorthItProperty from any claims arising from your use of the Website, your violation of these Terms, or your violation of applicable laws.

12. Owner & Contact Information Services

12.1 Permitted Use

Owner or contact-related data may be used only for lawful real estate research, evaluation, and legitimate transaction-related outreach.

12.2 Prohibited Use

You may not use such data for harassment, spam, resale, unlawful solicitation, or discrimination.

12.3 Compliance

You agree to comply with all applicable laws, including the TCPA, CAN-SPAM, and applicable state privacy laws, and to comply with Do-Not-Call requirements before placing marketing calls or texts. WorthItProperty assumes no liability for user misuse.

WorthItProperty does not guarantee the accuracy, completeness, or currency of any owner/contact-related information. You are responsible for verifying information before taking action.

13. API & Developer Access (Future)

WorthItProperty does not currently provide API access to users. Any future API offering will be governed by separate terms.

14. Termination

WorthItProperty may suspend or terminate access at any time, with or without notice, for any reason.

15. Governing Law & Dispute Resolution

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict-of-law rules.

15.2 Arbitration Agreement

Any dispute, controversy, or claim arising out of or relating to these Terms, the Website, or your use of the Website shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules.

15.3 Class Action Waiver

YOU AND WORTHITPROPERTY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate claims or preside over any form of class or representative action.

15.4 Time Limitation on Claims

Any claim or cause of action arising out of or related to these Terms or the use of the Website must be brought within one (1) year after the claim arose, or it shall be permanently barred.

16. Force Majeure

WorthItProperty is not liable for delays or failures due to causes beyond its reasonable control, including acts of God, government actions, outages, strikes, cyber-attacks, or failures of telecommunications or hosting providers.

17. Geographic Limitations

The Website is operated from the United States. Access from other jurisdictions is at your own risk, and you are responsible for compliance with local laws.

18. Feedback
